What’s the difference between puffing and misrepresentation?

PUFFING is a salesperson’s opinion or exaggeration that a reasonable person would NOT rely on as fact: "this is the best neighborhood in town" or "you’ll love this view." It’s legal because it’s clearly subjective. MISREPRESENTATION is a false statement of FACT that the buyer DOES rely on: "this roof was replaced in 2023" when it wasn’t. Misrepresentation is actionable under Florida’s Johnson v. Davis disclosure duty even if the licensee didn’t know the statement was false (it’s called innocent or negligent misrepresentation). The exam test: if it’s an opinion → puffing → legal. If it’s a verifiable fact → misrepresentation → liability.

When does a Colorado dual agent need to get written consent?

Trick question — Colorado doesn’t recognize traditional dual agency at all. The Colorado Real Estate Commission abolished dual agency in 2003. What you’re probably thinking of is "designated brokerage" — where the same firm represents both the buyer and seller, but two DIFFERENT brokers in the firm act as single agents for each. The designated brokerage relationship requires WRITTEN CONSENT from both clients, signed BEFORE substantive contact. The brokers can’t share confidential information across the wall. Compare this to: a Transaction Broker (the Colorado default) is a NON-AGENT who assists both sides — that doesn’t require dual-agency consent because it’s not agency at all.

Is transaction brokerage really the default in Florida?

Under F.S. 475.278, every Florida licensee is presumed to be operating as a TRANSACTION BROKER unless the parties affirmatively change the relationship in writing. This is the OPPOSITE of most states (which default to fiduciary single-agent representation). A transaction broker owes seven specific duties (honest dealing, accounting, skill/care/diligence, disclosure of material facts, presenting all offers, LIMITED confidentiality on price/motivation, and any contractually added duties) but does NOT owe full fiduciary loyalty. To upgrade to single-agent representation, the licensee must deliver and have signed the Single Agent Notice BEFORE showing property. To switch from single agent back to transaction broker mid-deal, you need the Consent to Transition form.
